Settlement deed between brothers

Dear  Sir,

My grandfather had an empty land in Tamil Nadu (Chidambaram district), bought from another person, but the original govt. documents (Pathiram) are not available.  After my grandfather’s death, my father gave portion of same land to his younger brother (i.e my uncle), just dividing the assets during their separation.   Only survey number and Chitta details are available.  No registrations made, no patta details available.   The land has been used by our family for more than 50 years (including my grandfather’s time).  Unfortunately, no taxes for anything has been paid so far. As per VAO records, it is mentioned  as  ‘Empty Natham’  (Kali Natham in tamil language).  Now, my uncle wants to share the land to my father  (i.e settlement deed between younger brother to elder brother).   When we tried for registration, the sub-registrar refused to register, saying the following reasons:

1.       It is Kali Natham, we cannot register, we need to apply for Govt. Patta and bring it for registration

2.       As per the Revenue record, the particular land is mentioned ‘Govt Porampoke’  (nearby a river).

The writer said that we can go for registration after getting Patta, however it is difficult as it is specified under ‘ Govt. Porampoke’.    Could you please guide us, how to proceed further.

You can file a declaration suit for the title of the deeds in the civil courts. Engage a civil court senior lawyer at your place.
