I have been appointed as professor on cadre post.one of my colleague also apperared in interview for the same but rejected.He also applied for personal promotion under CAS and recommended for promotion.The University accorded seniority to him.my question is how a person who is rejected can be senior to a person who is selected.The CAS post is ex-cadre post on which substatntive capacity remain unchanged but in U.P Universities Act section 31 A was inserted which provide the mode of appointment to the post of professor under CAS .what is the legal position of seniority between the cadre and ex cadre post.
