Selling of a piece of land in an unscrupulous way.

Hello,

Can my brothers sell of a piece of land that belongs to us (3 brothers) via any unscrupulous method such as getting my signature forged or in any other unlawful manner with notifying me. I know the property registration office would ask for

PAN Card, Photo, Thumb impression etc but in case my brothers sell the same without notifying me ..what process do i need to follow. Advance thanks for your response and help.

It is not possible to sell the land without your consent. It is not selling like palli Batana.

if u are sure ur brothers have indulged in this, then take out EC copy from the SRO,and copy document of the sale deed,in which ur signature was forged,and file a case under IPC 417,464,465,and include the buyer also,who had bought this property,under section 107 of IPC. on the civil side u can go for declaration suit for calling this sale deed null and void.

Hello...Thanks for your reply and letting me know the process as to what needs to be done in case my brothers sell the land in an illegal manner. I have also heard that in some cases people show a death certificate of their deceased brothers in order to sell the property. I just wanted to know the details so that i can take action as necessary.

if u are sure they are going to sell without ur knowledge, file partition suit now itself,to avoid unnecessary developments.

Thanks.. The property is in Kolkata and currently i am out of India for a few months. Can the partition suit filing be done with a help of a lawyer in Kolkata (provided i send the correct documents etc by post) or do i need to be physically present for the same. Thanks for your advice.
