Section 406

I have come to know that my wife will be filing a 406 case against me and my family. Please guide me the proceedings that will be taken by police and do I have a option to safeguard me or family befoe any action is taken.

Dear brother,

though u hv nt mentioned the act but i can fairly assume that u r talking abt section 406 of IPC. For an offence under this section, maximum imprisionment is three years. This is a cognizable and non-bailable offence triable by the Magistrate of the First Class.  You can seek anticipatory bail if u r under reasonable apprehension of being arrested whether any FIR has been lodged against u or not. After lodging of FIR, you can go for quashing of the same if you can cull out some good ground. whether u hav good ground or not can be seen only after the FIR. in case of any further discussion, you may contact on 99999 503 497. you will have defense that you have not misued the property of your wife or so.
