Section 164 of crpc

Hi All,

We want a the statement of the complainant to be recorded before a judicial magistrate as per the CRPC section 164. Can we directly file a petition before the Judicial Magistrate. We fear the police may temper the statement of the complainant in the FIR and the police is not recording the statement correctly and not putting appropriate sections in the FIR. Because the complainant is too old and we want it to be recorded properly so that it can be used as an evidence for next 100 years if required. Even if we request the police, the police may not go for a 164 section. Can we directly approach the court.

Please suggest.

You can file a petition before CHIEF JUDICIAL MAGISTRATE regarding this and seek his permission, then CJM will ask Judicial magistrate to record your statment under 164 crpc.
