sec 138

A personal loan was taken in year 2006 for 36 months.emi were paid 24 monyhs. later collection agencies collected 5 emi.Principal Amount was 3,00,000/-. Can bank now as of today apply sec 138.Kindly advise.

Can bank now as of today apply sec 138 ?

If You have given a cheque in respect of that emi and doesn't pay the amount as because of insufficient funds then bank can file 138 case against you.
