SC dismisses petition on uniform rules for HCs under RTI

January 22, 2008

The Supreme Court today dismissed a petition seeking directions to frame uniform rules for all the High Courts in the country to provide information to the public under the Right to Information Act (RTI), 2005.

A bench comprising Chief Justice KG Balakrishnan and Justices RV Ravindran and Dalveer Bhandari told the petitioner ”we are not the supervisory authority over the High Courts and this court cannot issue a guidance on the issue.” Ms Kamini Jaiswal, counsel for the petitioner, Public Cause Research Foundation, had earlier contended that various High Courts have virtually rendered the RTI Act redundant due to rules framed by them namely charging exorbitant fees from the public seeking information under the RTI Act.

The Supreme Court, however, declined to entertain the petition and dismissed the same.
