i entered agreement of sale with 2nd party a buyer.The buyer has paid cash component and transfer to my account through bank.the agreement has to be completed within2months.the buyer is after bank ffor loan and he did nt get the loan sanctioned till date.and the agreement expired.the sale agreeement is made on 10rs stamppaper.the agreement has payment schedule ,which the buyer has not fallowed.what privillege i have to forfeit the amount he paid?or return it back in return of cancellation?the agreement mentions an ernest amount but doesnt have clauses regarding failure of fulfillment from either side.kindly advice.
