Retail shop booking cancellation and refund booking amount

I had booked retail Shop in Noida with Booking amount of Rs 51000. Builder buyer agreement not done.

I want to cancel my booking due to some financial problem but Builder is not refunding any amount.

Bulider is saying that if you cancel the booking , you have pay  to 20% of earnest amount(total cost of property).

Please suggest.
