resign without notice for emergency

I can resign my company without notice for emergency, and have a proof.
but companys rules is resignation without serving the full notice period, this cases pay in lieu one month gross salary will be charge back and you will not raise any objection to pay back,
My question is my one month salary pay back is mandatary?

If you have agreed by way of an agreement executed bewteen you and the company then you should pay or they can file forrecovery  with exppenses...

One month's Notice Period is reasonable. In case of emergency and the employer willing, you have the option to make payment for the same.
