Replying to departmental SCN

I work in PSU bank. I got an SCN for negligence while working as forex officer. Some export credit account turned bad and I am being questioned for not exercising due diligence in monitoring the accounts. The observations are: 1. Not obtained credit reports of buyers 2. Didn't ensure whether the buyers were genuine and/or export did take place. My Branch Manager had instructed me against obtaining the credit reports verbally. He has also got an SCN for these accounts turning NPA.Don't have any proof. How should I reply so to close the inquiry's at SCAN level only. I believe accepting my fault will go against me, the management generally takes that as confession and proceeds further in the inquiry's.

Dear Mr. Raman,

Within your own bank, there may be some Officers who are helping people affected like you in dealing with departmental enquiries and SCNs.  Therefore, please approach them and take their help.  This is for the simple reason that they may very well know the procedure involved in granting of such type of loan facility, the steps to be taken etc. etc.

Have you consulted/approached elders of the family, seasoned employee’s/trade union leaders, a very able senior LOCAL counsel of unshakable repute and integrity specializing in Labor/Service  matters of unshakable repute and having successful track record?

Have you firmed up a seasoned defense assistant to defend you?

If NO then it is the immediate requirement, more so as per conduct of your boss in your case and approach of establishment and authorities in such cases...

Hope you shall take it positively.

You have grossly erred by jumping to act on verbal command of said boss who has gathered business but has acted against on slightest opportunity and variance from SoP………….and you have posted that you have NO evidence…….

The employee should mind his/her interest, and not interest of bosses, his/her own employability and stay away from delinquencies, misconduct…… …

Needless to mention you may approach a very able senior LOCAL counsel, defense assistant to mind your interest……… as already posted, to defend you.

If think you can handle on your own and defend your interest; go ahead.

while facing departmental inqiry one is entitled to call any service /retired govt/PSU employee to plead his case.

 

You may better check the CDA Rules of the bank and see whom you can call and select the person whom you can approahc.  Legal professionals are not allowed in departmental inquiry unless permissted by appointing authroity.

 

family eleder, union leaders, seasoned employee may or may not be well versed in departmental inquiry procedure.
