Rental agreement renewal

Dear Sir / Madam,

We have one shop at Andhra Pradesh, Nellore District. I am working and staying in Chennai. The  property is in my mother's name. Since my father and mother are having health issues they are staying with me at Chennai. The property is rented and a lease agreement is made for 11 months period. The period is selected such that the  registration is not mandatory.  Now the  lease period is over and we are asking the tenent to make fresh lease deed. But he  is going on telling some excuses and not coming forward for fresh lease deed. But he is paying rent promptly. 

Kindly suggest us how to solve this problem.   What are the consequences for owner and the tenent without valid lease deed.

If there is no valid rental agreement then in case of a dispute there won't be an evidentiary value to contest the disputed case.  However since it is a continuous agreement (even an oral agreement), you can always establish the landlord tenant relationship duirng a conflict or dispute on the basis of the rental amount received regularly.

As per the amendment in 1986, registration is compulsory even for 11 months in Andhra Pradesh.  You request that the tenant execute a rental agreement for 3 years, or as you agreed.  He is paying rent regularly, and you settle the issue amicably.

Issue legal notice through a local prudent lawyer to clear arrears of rent and vacate the premises.

Kindly suggest what is the valid reason to  ask him to vacate the premises. What are  the  reasons the court will support the owner

If the lease agreement is not renewed or if the tenant is not showing any interest in renewing the rental agreement you can issue a legal notice to the tenant to vacate the premises for the same reason and your unwillingness to renew the lease agreement due to his hostile and negligent attitude.

Non-renewal of rent agreement, premises required for personal use, violation of terms and conditions of last agreement, non-payment of rent for_____months, keeping the premises locked for more than________months etc. etc. are the grounds (as suits in your case) to take over possession of the premises.

However, you will have to seek  professional services of a local prudent lawyer for analyses of facts as applicable in your case,  which has to be specific and cannot be generalised / presumed, proper guidance and proceeding
