Reimbursement of medical expenses

A Railway employee retired from service at the time of retirement he had opted out to join the Railway Services Libralised Health Scheme and not paid the contribution towards scheme and also not made effort to join the scheme whenever it was extended.  He underwent surgent for cancer in a private hsopital and claimed the medical reimbursement the same was rejected on the ground he is not a member of a RELHS.  He joined the RELHS after the surgery and made a claim for reimbursement as now he is a member of the RELHS.  Whether his claim is admissible if so under what circumstaces with some case laws

How would he convince to benefit from scheme whose initial and regularcontribution was not paid?

 

You have posted that he opted for it!

 

Was it Railways responsibility to deduct or collect the contribution from any fund or dues?

 

If NO, it  would be again difficult to convince.
