Regarding maintanance

after 498A, my wife filled a case for maintanance. i have a kid 2 yrs old with her.under which section she can file the case for maintanance for her and for kid? my lower court lawyer is saying in Bihar there ia rule that 50% of husband's salary is belongs to wife. is that true? how the maintanace case will go on in bihar state.please help..

1. Under S. 18 HAMA for self and under S. 20 HAMA for child.

AND/OR

2. Under S. 125 CrPC for self as well as for the child

AND/OR

3. Under DV Act, 2005 for self as well as for the child.

AND/OR

If either party have filed any activity under HMA such as annulment or divorce then

4. Under S. 24 HMA for self as well as for the child.
