Regarding joint locker with either or survivor clause

Incase of separation between husband and wife due to disputes, what can be done to ensure that locker contents are not misused by the party that has the key of the joint locker with either or survivor clause. Bank manager just says that he can only request the party who presents the key to operate the locker in the presence of the spouse, but can force this instruction.

Write a letter to the bank manager that single party shall not be allowed to operate the bank locker and the steps are being taken to take court order to such an extent and the bank will be held responsible if a single party is allowed to operate the locker.  This letter hand over the manager and get acknowledgment.  Next immediately move the civil court to get prohibition of single party to operate the locker.  If the manager insists his helplessness, then first move the court and in this case make the bank also party and get the notice served.  The bank then will stop the single party to operate the locker.

Tnks for the response. Do i need to approach an advocate for this or i can do it myself? Also i am in a different state than where the bank branch is and where our marrige was held. So can i get a court order from here? How long does it take to get a court order? I had sent a letter to the bank but the bm called me n informed that he can only request my spouse to jointly operate but cannot force this on him.

1. You require advocate.

2. the case can be filed where bank is situated or where your husband is living right now..

3. Once file the case, seek temporary injunction, which can be granted within two days. If you make bank party, even injunction is not granted, mere service of notice will put them on their toes and they refuse your husband to operate it on the ground of "sub-judice".

Thanks. We both have been living in Pune, working here. He left his job n went to his native town n staying with his parents there. I m still in pune. The bank branch is at his native town. Can i get a court order from here as i do not have any contacts at his native town?
