Refund for defective product

Dear learned members,

If a person buys a product, which under warranty requires repairs say four or five times, such that if repair is not carried out then the product ceases to serve its intended purpose, does the Law provide to the consumer the right to a claim a full refund, and especially if the company is not ready to guarantee that the repair will be such that no further problems will recur?

Best regards,

Kunal Shah

Yes,you can approach consumer forum within warranty period for replacement of defective product and also claim compensation towards mental and physical agony caused to you.

Dear Adv. Goyal,

Many thanks for your response.

Can the consumer seek redressal from the Consumer Forum / Consumer Courts after say 6 months of warranty period, for the problems that were faced several times within the warranty period?

Best regards,

Kunal

With proper evidence that the product was defective and it was discovered during the warranty period itself and informed to the seller on time, will be enough to file a complaint before the consumer forum.

Thank you Adv. Kalaiselvan!!
