Refund excess stamp duty paid

Hi,

 

Recently I have done registration / agreement through advocate/lawyer with seller to purchase resale flat. Advocate asked me to pay 110000 Rs stamp duty so accordingly I did. But later I came to know that stamp duty which is required to be filled only 100710 Rs and not 110000 Rs. That means I have almost paid 9300 Rs extra in stamp duty. I asked to the lawyer regarding this & he said that it was his calculation fault.

Can I get this extra paid amout back to me? what is the procedure??

Yes you can get back the stamp duty.  You have to make an application before the sub registrar office.

but which sub registrsr office? the same where I have made property registration or any registrar office??

 

Also I want to know that I can directly apply or I have to apply through lawyer??? & which documents needs to be submit with application??

You have to apply in the same sub registrar office. The party who paid stamp duty can apply.  Advocate is not necessary.
