In case of redevelopment of scoeity, please confirm whether member is eligible to get car parking. According to my understanding car parking is mandatory to provide to all existing members in society. if its mandatory, whether it should be stilt parking (car parking is generally provided for in the basement or stilt floor (covered car parking space) or parking in the set-backs (open car parking space). As per my understanding covered parking shall be provided
Further whether Corpus Fund is to be provided mandatory to members or not. My understaidng says it is provided on per sq feet (as per the carpet area). What about provision related to corpus fund i.e. rate per sq feet is not mentioned any where in the Development Agreement, MOU etc., still member can ask for corpus fund or not. Any guidelines etc which advices on the rate per sq feet for corpus fund?
Also if society / builder is agreed to pay corpus fund / car parking for the safety it is required to be covered under the agreement between member and builder. However if builder is not ready to cover Corpus Fund related provisions in an agreement then what is to be done?
Can anyone inform on "Court Consult' which is to be done before signing and execution of an agreement between individual members and builder? Also exact procedure how the same can be done and the relevance of the same
