I booked an apartment with a builder in 2008 and made installment payment from 2008 to 2010. The builder mortgaged the land and the building constructed over it in March, 2012 without my consent. The builder stopped construction and defaulted in making loan payment to the Bank. The bank has taken over symbolic possession of the land and the building. and would recover their loan by auctioning the land and building constructed over it. What action should I take. What case to be filed in Civil Court. Or Whether I should file a case in DRT. Please advise.
