Marriage registration

X is 26 years old Man & Y is 25 years old women, they have performed marriage in a small rural Temple on 08th February 2012. Now they want to register the marriage under Special marriage act as district magistrate here only registered marriage under Spl Marriage act. Can there any provision that after solemnizing marriage in temple without the consent of guardian is not to be considered as social marriage ? Can the notice for marriage already solemnized be applied now or they have to wait for 30days ? Both the parties belongs to same jurisdiction of the Dist magistrate. What are the precaution the boy has to take if the parents of the girl lodged any FIR against him though they both are matured even then , they want to avoid unnecessary police harassment as without completing 30days of notice period marriage can not be registered. regards Adv S.Paul

hi,

no need if u performed a marriage in a temple then submit the photogarph of the marriage and certificate from the pujari of that temple that he performed the marriage go and register yr marriage with the concerned authority. u wl need 3 witnesess. to avoid police harrasment just go to yr near police station and record the statmen of the girl stating that u both r major and u married with each other with your free will and consent.

SIR UNDER HINDU MARRIAGE ACT IT IS POSSIBLE TO REGISTERD A MARRIAGE IMEEDIATLE IF U WANT TO REGISTERED UNDER THE SPECIAL MARRIAGE ACT THAT WILL TAKE 30 DAYS NOTICE. SIR LET ME KNOW WHY DO YOU WANT TO REGISTER THE MARRIAGE UNDERB SPECIAL MARRIAGE ACT?

श्रीमान जी / श्री मति जी,

१. मेरे दोस्त की शादी आर्य मंदिर (दिल्ली) में हुई जिसके सभी प्रमाण-पत्र और फोटो है उनके पास है

२. और इसके बाद उसी दिन शिव मंदिर (गाजियाबाद) में उन्होंने फिर शादी की

३. लेकिन शिव मंदिर में की हुई शादी का उनके पास ना कोई फोटो है ना कोई प्रमाण-पत्र

४. उन्होंने पंजीकरण गाज़ियाबाद में करवाया है

५ लड़का लड़की दोनों फरीदाबाद के रहने वाले है

६. जब शादी का पंजीकरण उनके पास आया तो उन्हें पता चला की उनके पंजीकरण के शिव मंदिर लिखा हुआ आया है

आर्य समाज का कहीं भी नाम नही है उस पंजीकरण में

७. लड़के लड़की क घर वाले इस शादी के खिलाफ है

८ अब मेरा सवाल ये है की क्या यह पंजीकरण वैध है

९ अगर लड़का लड़की कही भी जाते है तो क्या इन्हें कोई मुशीबत तो नही होगी

१० उन्हें बिना घर वालो को बताये कहीं जाने के लिए क्या करना होगा जिसे पुलिस उनकी सहायता करे

११ अपनी जिन्दगी को सही स चलाने के लिए और हर मुशीबत स बचने के लिए उन्हें क्या करना होगा

१२ लड़का लड़की दोनों जॉब करते है लड़के की सलारी १५००० है और लड़की की १२००० वो साथ खुश रह सकते है

AS PER SECTION 15 (F) OF SPECIAL MARRIAGE ACT :-

"the parties have been residing within the district of the Marriage Officer for a period of not less than thirty days immediately preceding the date on which the application is made to him for registration of the marriage"

WHAT it means the word "residing" ....is it residing as husband and wife. If so then if some one marry today then they have to wait for 30day to make application then another 30days for notice period....that means after marriage 60days have to wait for registration.
