 How cognizance was taken if it is not your cheque? In other words, no proper verification of facts was done. It frivolous and abuse of the process of law. You can certain taken legal action against the complainant for defamation. I think there is a judgement of the Supreme Court in which it was ordered that the magistrate himself can order filing of criminal case in such instances.

With due respect to all learned advocate friends as per law settled by Supreme court after adalat prasad case which stands now that even High court has no power to hear any application u/s 482 once a process is issued.

The gentalman has not given full details, It is just not possible that he has not issued the cheque and process is issued. There must been a notice by the complainant to the accused  giving all details.

If true which seems  impossible , file a perjury case against the complaint and all persons assisting him.
