I was an NRI when I married in the first quarter of 2010, after marriage my wife started giving me a lot of torture due to which I left my job abroad and came back in India for good in the first quarter of 2011 (actually wanted to save my marriage) however after i came back things became worse between us and finally my wife left my house on end of may 2011. My wife left India to stay with her parents in abroad
After 6 months of her refusal to come back I filed for divorce and when she came to know about this she came back and filed a false dowry case against me & my family u/s 498A.
I applied for anticipatory bail for myself and my family which was granted by the hon judge on the first hearing itself.
I have all papers to prove that I am the victim in this marriage and everthing that my wife has mentioned in the FIR is false.
Currently the police are working on the chargesheet that needs to be filed by Feb 2012.
I would like to know is this the right time for me to apply for Quash petition in high court or should I wait for the chargesheet to be filed and what would be the approximate cost involved for myself and my 4 family members?
Any assistance will be greatly appreciated.
