Publication of legal notice.............

Dear Members, please inform whether a Notice or Summons can be published in the News Paper in Family Proceedings (Divorce & G&W) & Criminal Proceedings (IPC-497 & 494). In some of Applications/Complaints filed by me the accused is not attending the proceedings and no notice or summon could deliver as the accused is escaped from the town. 

Can I request Family Court or Cession Court for publication of Notice or Summons in the News Paper ?

Experts are requested to kindly inform the possibility and legality as well.

if The summons were not served to the respondant hence the court proceedings / trial is not started therefore move an application in the family court for seeking permission to publish the notice in the leading newspaper, same move an application in the criminal court and informed The magistrate that the accused had absconded and the summons were not served to him hence the proceedings of 82&83 crpc may be started against him and request the court to declare him absconder and give permission to publish in the newspaper.

File an application before family court under Order 5 Rule 20 of CPC for publication of the Summons/Notice against the defendant the court may pass an order in this regard.

20. Substituted services

    (1) Where the Court is satisfied that there is reason to believe that the defendant is keeping out of the way for the purpose of avoiding service, or that for any other reason the summons cannot be served in the ordinary way, the Court shall order the summons to be served by affixing a copy thereof in some conspicuous place in the Court-house, and also upon some conspicuous part of the house(if any) in which the defendant is known to have last resided or carried on business or personally worked for gain, or in such other manner as the Court thinks fit.

    22[(1A) Where the Court acting under sub-rule(1) orders service by an advertisement in a newspaper, the newspaper shall be a daily newspaper circulating in the locality in which the defendant is last known to have actually and voluntarily resided, carried on business or personally worked for gain.]

    (2) Effect of substituted service-Service substituted by order of the Court shall be as effectual as if it had been made on the defendant personally.

 

    (3) Where service substituted, time for appearance to he fixed -Where service is substituted by order of the Court, the Court shall fix such time for the appearance of the defendant as the case may require.

File an application under section 64/65 of Cr.P.C before Criminal Court for summoning procedure.

Section 64 – Service when persons summoned cannot be found

Where the person summoned cannot, by the exercise of due diligence, be found, the summons may be served by leaving one of the duplicates for him with some adult male member of his family residing with him, and the person with whom the summons is so left shall, if so required by the serving officer, sign a receipt therefor on the back of the other duplicate.
Explanation – A servant is not a member of the family within the meaning of this section.

Section 65 – Procedure when service cannot be effected as before provided

If service cannot by the exercise of due diligence be effected as provided in section 62, section 63 or section 64, the serving officer shall affix one of the duplicates of the summons to some conspicuous part of the house or homestead in which the person summoned ordinarily resides; and thereupon the Court, after making such inquiries as it thinks fit, may either declare that the summons has been duly served or order fresh service in such manner as it considers proper.
