Property transfer

Dear All,

My grandfather has 3 sons and 1 daughter, Out of which his eldest son who is my father and his daughter do not look after him. They physically and mentally harass him even during his old age. He and his wife stay alone in the village and his other two sons stay in jaipur with their family. My father has dis-owned me from his property and no longer looks upon me as his son. I am on my own and partially looked after by my grandfather and my two uncles. 

My question to you is that my grandfather now has decided to divide his 9 acre land property among his children excluding his eldest son who is my father and his daughter. He wants to give me the share of my father's inheritance and not to him. He even wants to give me the rights over the house property where my parents stay forcefully. So what are the legal laws and procedure by which my grandfather can do so without my father objecting and not allowing him to do so.

Is this kind of inheritance possible..?? If yes then what are the legal procedures that can be followed.

You have not stated about your caste.  If you are Hindu by nature and if it the self acquired property of your grand father, the legal position is as follows.

Your grand father can make a gift deed of his properties including the occupied house to you.  Your father has not right to object.  The stamp duty of gift deed varies from state to state.  In A.P. it is 1% on the govt rate of the property.  Enquire in local sub registrar office.

I advice to go for WILL, it gives the opportunity to change his mind later on.

If the property is the self acquired property f your grandfather, he has full rights to dispose it in any manner her feels/desires and to any one he wishes to transfer the same.  In this regard, if yes to above, your grandfather may make a gist deed and register the same in your favor which cannot be legally objected  to by anyone including your father. Your father has no rights of inheritance or share in the property.
