Property right

My Sister in law is creating troubles for my father and mother who is senior citizen.

My Sister in law married with my brother in 2000 and had a daughter. Her parents always misguide her and now the things become worst. My brother died because of daily problems, her parents interfared in their life every day. 

After death of my brother she left the home as her parents took her in a planned way.

Now she had filed domestic violance case against my parents and wants share in the home in the name of daughter which is created by my father itself without any ones help. She is showing that my father had thrown her out and now she had no roof to stay under with her duaghter.

My Father is retired 11 years before and had already spent his all money on brother and his family. Now he only have home, which she is trying to get.

we have the vedio recording when his father took her both from our home. Nothing is happening in case. 

Please suggest !!

first you please clarify that home is whether self acquired property or inherited by your father from the ancestors.if it is the ancestral property, then the sister in law can have a say in the property otherwise if it s self acquired property, then your father can do anything as per his will and wish. no one can question or claim the right.

It is self acquired property of my father.  Not at all shared property.

1. Is it necessary that my father needs to pay something for monthly expenses for sister in law and her duaghter ?

2. Can grand daughter claim for some thing in property after some years ?

3. If my father do register some will or gift it to any body then in that case can grand daughter or daughter in law chalange it in court by now or after some years?

Opinion: Follow the procedures led down under senior citizen ship act.

Opinion: Very sad state of affair's....

 

After death of my brother she left the home as her parents took her in a planned way.

 

Opinion: If the fact's led down by you is of true in nature then she would be held in the cause of her husban'd death and should be penalized under Indian penal code 1860.

 

Now she had filed domestic violance case against my parents and wants share in the home in the name of daughter which is created by my father itself without any ones help. She is showing that my father had thrown her out and now she had no roof to stay under with her duaghter.

 

Opinion: No right's on alive grandfather's property or self earned  or by inheritance property.

Ask your father to file civil injunction suit on her if she is becoming pain for them and disturbing their old age life.

The wife and child has legal right on deceased husban'd self earned asset's of movable or immovable properties and not on FIL/MIL/BIL/SIL.

The responsibility of feeding the child and taking care goes to those in whose custody the child is being held.

Consult a good civil as well as family lawyer and discuss your case with him and do the needful act acordingaly.
