property case

We are 4 children 2 sisters and 2 brother. Our father died on 06 jan 1999. My mother and father were living separtely from 1996 to 1999. Iam not confirmed whther they are judicialy seoarated or not, but im confirmed that they were not divorcee.

Im yonger to all.

2 eleder chiledren sister and a brother are married.

this married elder brother is living with us in a same house, he putted a wall in a back portion and living separtely.

younger brother is living separate.

My mother is a senior citizen living with me.

Now problem is that:

All the three children hs putted a case against my mother that she has no right to live in this house as she was divorced and the the papers are on our father's name.

they prayed in their case suit and asked to vacant the home by their mother and after that this home shoould be distributed in 4 children.

if anybody is there who can help me to sought out the problem then please reply me so that i i will xplore the papers status and get the guidance.

Your mother can not remove from the house. She is also one of the share holder of your father's property. Further it is son's duty to look after old aged parents day to day necessities. If sons do n't look after her she can file a case for maintance.

One more thing is here

We have orignal GPA (power of attorney)

In which Agreement to sale, Will(wil of that person from my mother bought the plot), A receipt,GPA.

All the papers refers my Mother's name i.e.SAmpati (Except GPA paper),out of which two papers are ragistered (WILL and RECEIPT).

GPA referes my father's name i.e. Mr. Prateek.This paper is not ragistered.

In our last date judge said that according to all these papers ownership goes to this lady i.e. Sampati  is the absolute owner of this property.

But second party objects and got a next date i.e. 27th oct.

Now the second party's lawyers saying that there is a law which show that if a gpa paper referes a persons name then ownership goes to that person.hence the property will goes to his childrens and legal heirs.

Could you please let me know that whthr there is any such law or not.

tomorrow is our case date that is why im getting worry.

Priority will be given to the Legal heirs not to GPA holder.
