Procedure for divroce case in indian courts

Hi All,

 

Wife field Divroce Petition in family Court and court sent notice to Husband and Husband is attending court on 25-NOV-2014.

 

Wha is the next step in Divroce Case..... is it filing counter / Written Statement by husband or something else it is ....

Please help me in understandign the steps involved in Divroce Case proceedings ....

The next step is you keep climbing those steps which lead to the family court until you have holes in your chappals/shoes, one day those chappals will also get torn, still you will keep climbing those steps religiously :-)).  Buy a pocket diary, it will be of great use in the coming years.

Divorce case procedure [contested]:

1.  Filing or written statement. [November 2014]

2.  Issue of summons to respondent.

3.  If respondent is not present in given address, summons notice will be pasted on the door, next paper advertisement.

4.  If respondent accepts summons, next reply to the WS.

5.  Evidence of respondent and marking of documents.

6.  Evidence of petitioner and marking of documents.

7.  Cross examination of respondent.

8.  Cross examination of petitioner.

9.  Arguments.

10.  Orders/Judgment. [December 2021 or 2022]


Mutual consent divorce:

1.  Summons.

2.  WS, ie First motion.

3.  Second motion. [after 6 months]

4.  Orders/Judgement.

One of the above post by Helping Hand sates as below, does these steps are correct?  I assume first the Divroce Petitioner shall give evidence then after that Respondent of the Divorce ... correct me if I am wrong?

Dear Siv,

If it is not Mutual Consent, just relax. This case is going to take its own time. Focus on readjusting your life now. Slowly you will learn the threads. Its like extra slow motion. Point numbers 5-8 is a long time away. First ease your mental stress. Chill.
