I have bought 1 BHK flat in Navi Mumbai,Roadpali Kalamboli.As per agreement I paid 98% amount to the builder and builder agrred to give possession of the flat on or before September 2012(it is mentioned in the agreement also) Many times I called the builder regarding to give possession,but he said to me that without receiving Occupancy Certificate from CIDCO he is unableto give possession of the flat.
Finally I obtained O.C, Completion certificate from Architect and balance 2% amount demand letter from the builder on 22/12/2012. I have produced these documents to my bank and requested in writing the bank to relase the balance 2% amount loan DD ASAP.As per my written request bank released balance amount DD within a week.
On 27/12/2012 I personally visited to site at Roadpali and found that there were no water supply,electricty supply,as well as internal bathroom fittings were not fitted also internal staircase painting was balance.At the same moment I called the builder I asked the reason but he did not give satisfactory answer to me therefore I refused to handover the balance loan amount DD to him and the same DD is lying with me since to months,unnessarily I am bearing interest on this amount.
I sent informal letter thru Register A/D and I have received acknowledgement also.After that again I visited and found that still electric supply is not there.Builder is ready to give the posssesion letter to me,in such case what to do?
I want to know that even though work was incompleted how can Architect issue completion certificate and CIDCO can issue Occupancy Certificate?
Could you please guide me what is to be done?
