Private property/ common passage

I had purchased my property in 1979 and one of my neighbors bought his property in 1981(both of us bought the property from the same owner). There is a stair case running parallel to my property. Now the owner from whom I had purchased the property included the stair case as a private property( solely to be used my me, the map shows it as a private property as well). Nobody ever used the staircase because it was in a poor condition. I got the stair case repaired some years back and for my safety I put a gate there and locked it. Now the neighbor says that his map and the registry papers say/show that the stair case is a common property (he has 2 other ways to access his house). So please help me and give me an advice about what should I do. Thanks and Regards

if there is a dispute then you need to approach the civil court and obtain injunction against your neighbour fthereby restricting them for using your property as a common passage.

It is advisable to approach the court at the earliest and obtain such orders before your neighbour approaches the court and get injunction orders against you for stopping his passage from your property.
