Dear experts.
a chitfund company filed a case on NI act on chit bidder but now not functioning but an agent who self exposed legal assistant filed a petition under order 3rule 2 of cpc and rule 32 of civil rules of practice.
As of now the company is not existing and foreman and directors are absconeded due to cheating cases filed others cheating cases aganist
them .
one of my clients paid the chit amount but security cheque being with them filed NI act one of the collection agents on behalf of the ompany.
My question is or doubt the petition filed by him allowed the court but as per their bye laws foreman man has to conduct the chit but how the agent or self exposed legal assistant can represent on behalf of the company on the basis of resolution passed in 2020 issued only the managing director but there are two directors as the company is regustered under the Indian companies act
