Power of attorney

Dear sir

 

My father had given a power of attorney to his brother few years back. Now my father has cancelled it, now we have learned that he had borrowed pledging my father's property to a pvt lender and used my father's power of attorney to sign an agreement of sale.

 

Now we are going to settle and we are going for a partition.

 

my query is that

 

1) How to nullify or cancel the pledged documents. Should we get an agreement signed by the lender saying that he has received the amount and hence the sale deed is null and void.

 

2) how do we know where all he has used father's poa and how can we come out of such liabilities (if any)

 

3) Also what are the provisions for filing a civil & criminal suit against my father's brother for misuse of power. As he has totally done this without my father's knowledge.

 

Please help me get a basic idea before i visit an Advocate. Thanks in advance
