Possession letter

I have bought a flat recently and got the OC of the building a month back. Now my builder is not giving me the possession letter and asking me for maintenance charges for another year (2014), although I've paid the same upto Dec 2013. I doubt that when the society is formed that will not be transferred to the society account. I have rented out the flat and want the income tax rebate on the home loan that I've taken. Whether I'm eligible to get this? Whether the builder has any compulsion by law to provide me the letter within a certain period of time? The flat was actually a resale flat that the builder has sold to someone during the construction period and the previous owner didn't get the possession letter since OC was not available then. Now whether the OC from the builder only suffices or I have to get any letter from previous owner as well.

No dues certificate to be obtained from previous occupier through society.
