Possesion of the flat

Brief -

Husband died before the judgement of divorce petition. Husband has given power of attorney to his brother of his flat. Wife is only the legal heir of the flat since there was no issue out of wedlock and father and mother of husband are no more.

1. In this case what will be the legal status of the power of attorney?
2. Whether that power of attorney is still valid?
