Plots shifted after booking

I had booked two plots in a Company’s project at Kolkata by paying 20% as booking amount. This company provides plots on EMI scheme (48 months). I paid the amount through cheques. Later, I cancelled the booking of one plot for my personal problems, and requested the company to transfer the total paid amount to the other plot. So, for this plot, 40% had already been paid. There is no legal agreement signed.

After few weeks, the company sent me a letter saying that master lay-out plan has been changed and my plot has been shifted to a different one. When I booked the plots, there was lot of open space and a proposed Children's park present at the backside of my booked plot.  But according to the new map, there is no such proposed space. So, I wanted to cancel the booking and asked the company to refund the full amount. They told me they will deduct 25% as per the Terms & Conditions of the booking form.

 

My question is:

As they have changed the master plan, removed the empty space near my booked plot, and shifted my booked plot to a different one, can the Terms & Conditions be still applicable?

Refer the terms & conditions about booking. If any conditions is there about the rights of changes, they are correct and must be informed in writing. orherwise send a legal notice.
