Recently a "specific performance" decree was passed against me to sell my plot the plaintiff (by lower court) at 10 year old price. But later it emerged that he had bribed my lawyer and therefore he didn't present the case properly in the court. I have also found out that the plaintiff had taken a stay order against selling my land to any one else a couple of years ago. My lawyer didn't even inform me of that.
Now I have shown the judgement to many lawyers and everyone says that I'll easily win in the appeal (in the session court) as there is nothing in the case.
What I want to know is if I win the appeal, can I sell the land to someone else before the plaintiff files appeal in the High court? I mean what would be the status of the stay order, which was passed by the lower court. Or do I need to seperately contest the stay order.
Your help would be greatly appreciated.
