Dear All,
Plaintiff/D.H filed money compensation suit against R1/JD1 & R2/JD2. As per Court Judgement/Decree R2/JD2 has to pay. In this situation D.H has wrongly filed E.P against R1/JD1 & R2/JD2. Whether the Plaintiff/D.H amend the filed petition now on R2/JD2. Any Case Laws to support the same.

I am trading in maharashtra.trader from gujrat sent me material without order & high rates before 2 years.i tried to sell that andrequested party to to take back but material was not fully sold and meanwhile expired.& damaged i paid partly payment to him through cheque.for balance payment he filed recovery suit & send me summons through civil court gujrat .i have not received summons in time because postman delivered it on wrong address.i mean summon accepted (registered ad) by another party and after 1month he handover me.so in this situation how can i face court as well as party
