Our tenant vacated the house, and after that we did not pay maintenace charges for four months. Maintenance is due by the 10th of every month. We have now paid the maintenance charges fully. However, the association has charged a penalty of Rs. 100/- per week of default on the maintenace charges of each of the four months. This penalty clause is present in the association's bye-laws. So, the penalty comes to a total of Rs.3,400/- for four months (1400+1100+700+200). Is there any stipulation in the Tamil Nadu Societies Registration Act as to the maximum amount or percentage that can be charged as penalty? We are willing to pay the penalty as per law.
