Pay protection, grade pay from state govt. to central govt.

Dear Sir:

 

I was working as a Lecturer in my service and got the 6th Pay Commission fixation in the 15600-31900 Pay Band. From July 2009, I have been promoted into the Senior Scale which has the grade pay of Rs. 7000. I resigned from this post to join a Central University as Assistant Professor. While joining the Central University gave me a grade pay of 6000. I had opted for pay protection and according to this the Central University has revised my pay in pay band but the grade pay is still 6000


My query is this:


1. Will my grade pay be protected? i.e. will I get the Rs. 7000 grade pay when I joined the Central University?

2. If not why? and what is the solution. As I would loose the normal seniority of promotion and thus be eligible for promotion after accumulating more number of years in service.

My cousin has joined IRS on 21-12-2009 and worked till 30-09-2013 before joining IAS on 02-09-2013 after submitting a technical resignation to CBDT. The service confirmation as ACIT Junior Time Scale (15600-39100) [plus Grade pay of Rs 5400/- in pay band-3] with effect from 21/12/2011 and appointment as Deputy  Commissioner of Income tax [senior time scale Rs. 15,600-39,100/- plus the grade pay of Rs. 6600/- in pay band -3] with effect from 01-01-2014 have been received after the date of acceptance of the technical resignation 30-09-2013.

My query is whether he is eligible for pay protection of previous  Junior grade pay till 31-12-2013 and STS from 1-1-2014 to till date.
