Partition suit - out of court settlement

Hi,

I have filed a partition suit for my lawful share in an ancestral property. The first hearing is in two months time. Please advise the legal process involved in settling the dispute in an out of court compromise.

IN COURT PROCESS: the Court will look into your claim and will decide your share considering shares of other legal heirs.

 

OUT OF COURT SETTLEMENT: in this case, shares and claims of all legal heirs can be settled in a Partition Deed. As a valid partition deed always have signatures of all legal heirs and witnesses, then it is unlikely that other legal heirs may raise any dispute regarding partition.

Thanks.I have one more question.i have filed the suit on 6 properties in my native village.My brothers and cousins are refusing me any access to the disputed properties causing me grave hardship.Can the courts grant me interim relief till the time the case is settled.
