Parking space is small

Dear Sir/Madam,

I bought a property in Wagholi, Pune sometime in Aug'2012. I was shown the parking on papers. During the period of construction i visited the site many times but never tried to actually put my car inside my parking, as construction was going on. 

This area is out of PMC (Pune Municipal Corporation) limits & is managed by Gram Panchayat. But my sales deed & registration was done in PMC.

As per PMC development law, every parking should be 5m(widht) X 10m(Lenght).  But my parking space is less than that. It is around 4.5m(widdth) & 9m(lenght). It can barely fit my Santro car in it. If i wish to buy any bigger car in future, it would be impossible to park it.

I have not taken possession of my flat yet even though i have paid full amount to Builder. I have to pay Maintanence amount, but if i pay it, i have to sign a document stating i'm okay with the condition of my flat & parking space. Which is i don;t want to do.

In my contract, parking space dimensions are not mentioned anywhere.

Please let me know if i have enough grounds to fight a legal battle for proper parking space & secondly, if i go ahead with legal action, will it delay possession of my flat?

I also need lawyer for same in Pune. I want to file case in consumer court first.
