If you are Hindu then the proeprty in the name of your mother shall devolve equally upon you, your brothers/sisters, father.
Submit death certificate, legal heir affidavit/certificate to the authority under whose jurisdiction the property falls..........................Or inquire procedure from them obtain forms and submit.
If property in ther name of yuor father is self acquired/earned then he can dispose it in his life time as it pleases to him by gift/sale/WILL etc................
