Double jeopardy is a procedural defence (primarily in common law jurisdictions) that prevents an accused person from being tried again on the same (or similar) charges following an acquittal in the same jurisdiction.

Protection against Double Jeopardy is a Fundamental Right which has been guaranteed in Article 20 sub-section 2 [i.e. Article 20(2)]of the Constitution of India.

Article 20(2) states that - "No person shall be prosecuted and punished for the same offence more than once".

This provision enshrines the concept of "Autrefois convict" a Legal Maxim which states that - No One Convicted of an Offence Can Be Tried or Punished a Second Time.
