Informal parking allocation in society

Respected Sir/Madam,

Builder has given us a formal parking allocation letter. Let’s say there are 20 parking slots but then builder has not assigned any numbers in the allocation letter. The allocation letter just says 1 parking in parking space.

A society member has handwritten flat numbers and assigned stack numbers on plain paper and circulated that list in a whatsap chat.

Can such a handwritten note on plain paper be considered as formal allocation or should it come from the secretary on the formal allocation on societys official letter head paper?

Legally parking cannot be sold by builder / society, which forms part of common area, however, slots can be earmarked for use of members/ flat owners/ residents of the society complex.

The society member's handwritten allotment/allocation of parking slot is not legally valid, if the builder has not allotted particular parking slot to each member, then the association has to take care of this issue collectively

The society shall discuss the issue in the AGM or Special General Body meeting.

Does the flat sale agreement states the parking lot also? Have you paid for the parking lot? Generally open parking lots are not sold by the builder. In Mumbai the Model Byelaws say that parking lots will be alloted by the Society to members on payment of parking charges basis. If there are more applicants than the availble parking lots, the lots will be allotted on a first come first served basis or by lottery.
