Dear Legal Fraternity

What is notice pay? What are its salary components ?. Whether ESI & PF recovery has to be made to notice pay ? Whether notice pay may be adjusted against leave accrured ?

if any employee leaves his/her own or if the employer teriminate any employee's work at any time, both the sides are reserved to collect/pay  some compesation amount. it may be 3 months/one month i.e as per agreement/understaanding at the time of offer accaptance. But this amount considers like salary treatment which attract pf,esic.pt like all other thins as how salary proceddures. for futher more clarfication u can approach any leading labour consultant.

Dear Kumar,

Notice pay does not include ESI & PF. If your oganization has the provision for leave encashment notice pay can be adjusted against the amount becoming due in lieu of permissible leave period for encashment.

Notice pay is the compensation paid by the party who breach the condition of employment of giving notice prior to terminating services or resign services of an employer in lieu of said notice.. Yes, it can be adjusted against leave accrued.

Notice Pay does not include ESI & PF it is the gross monthly salary..........
