Not getting EPF

Dear Experts,

One of my friends has ended his tenure with organization on 31 January 2013. His PF was claimed by organization on 22 April 2013 to EPF department. On follow up, EPF department said they have lost his claim record. Now, his record does not exist on the EPF portal and EPF department asked him to resubmit his claim. Organization resubmitted claim on 15 July . The HR informed him to wait for further 30 days. My queries are-

1. Should the employee wait for 30 days even after resubmission?

2. What should be an appropriate way of getting PF and compensation for the delay keeping the situation in mind? Organization has given him all the relieving certificates and says its between EPF department and the employee.

Ask your friend to meet P F Commissioner with all your doubts.... In the normal course P F Dept settles the claim

Ans : Yes

 

2. What should be an appropriate way of getting PF and compensation for the delay keeping the situation in mind?

 

Ans : He gets interest on PF till the date the cheque is issued by EPFO

Organization has given him all the relieving certificates and says its between EPF department and the employee.

 

Ans : They are right.

You may ask the employer to supply you the acknowledgment issued by concerned PF office (for you) to you, for your 1st claim.

 

You may submit the new set of forms to employer and ask the employer to supply you the acknowledgment issued by concerned PF office (for you) to you, for your fresh claim.
