Non registraton of flat by builder

Dear experts, I purchased a 2 BHK flat from a builder in Ranchi (jharkhand) in 2004. agreement was done in 2004 & possession was taken in 2006.my flat is still un registered. Builder has made an illigal construction in apartment premise which is meant for car parking. There are total 6 flats in the apartment. Total area of land is 2880 sqft. Registration of 480 sqft has to be done (undivided share of land) per flat owner, but he says he will register with 440 sqft & wants to regularise his illegal construction. he has registered 2 of the flats with 440 sr ft specification. now we are 3 flat owners fighting for extra 40 sqft land. we have given application in local development authority, DC, DSP but still there is no action, also builder has not provided all 3 of us with NOC & possession letter. I just want to know-

1. if  we get our flat registered with 440 srft land share  & fight for other 40 sqft, can we get that.

2. what is the practical solution of the problem

3. To what extent builder can create trouble for us
