Non occupany charages

Dear Mr.Agrawal 

i need one expert advice from you , I am having a flat in Mumbai and the same  I have given on Leave and licence.  My society is charging one month rent as(aminity fund in my socities word) non occupancy charge and the same I refuse to pay.  Now they are charging 18% interest on this amount.  I am regularly paying my montly outgoings. 

I requested to the society to give me the copies of the minutes passed on various occations on the above mentioned subject.  But till today I have not received any reply from my society.

State Government issued an Order dated 1.8.2001 in Public Interest under Section 79 A of the M.C.H.S. Act, there by directing the Societies not to charge non-occupancy charges beyond 10% of the service charges (excluding Municipal Taxes).
