Non occupancy charges leveid by the society

Can a housing society demand one rent as non occupancy charge.

Dear Mr Hemant Agarwal,

thanks for your reply.

I had purchased a flat in malad east in 2006, which i rented for few years. Now presently the above flat is occupied by my sister since october 2014. Society has been asking me one rent every time i rented a flat and they have asked me to pay a sum of Rs80000. I have been telling managing committee that i am ready to pay the 10% non occupancy charges as per the rule but they are demanding one rent saying the resolution is passed in the AGM of society. Now they are threatning my sister and her in law  for not to use the lift inspite of maintaince being paid regualarly. For this reason they have held my share certificate and nomination form also.

After 5 years of society being formed they are not yet giving maintaince bill showing break up of maintaince bill. They give a receipt.

kindly advice me what should i do.

Yes, Society can take Non Occupancy Charge. It should be 10% of total maintenance charges.
