Non clearance & harassment

Sir/ Mam,

I, Gaurav Singla, has been working in a construction company for last one year from now. My job responsibilities as assigned are site execution. I have resigned dated 30th Jan'14. Since then I have conversed with my Project In-charge a several times. He has constantly being harassing and threatening me for destroying my career.

When I asked then that I have to leave urgently due to problem, they refused saying that the company has some reconciliation work pending. As a matter of fact, I have never been in billing department and accounts section. Now they are accusing me of miscalculation and accounting mistakes and are saying to stay till final audit happens. When date has been asked, officer responds blank.

Now, I have left site with written mail and conversation with HR in head office but they have issued a "Absconding Letter" in my name and are asking me to come back immediately otherwise they will take actions.

Please help urgent.

Send a registered post letter intimating your decision of resigning your post as well as attach a copy of your email so that it becomes an evidential record for the litigation tat may arise in the future in this regard.

Employee should avoid abrupt termination and should always handover the charge/company property.

Since you resigned with immediate effect the company may adjust notice pay in FNF statement.

 

Once employee has resigned he has ended the employer-employee relationship.

Absconder is a derogatory word.

You have resigned by sending email. If you have submitted a copy by normal post also, you have submitted proper resignation. You may submit another copy by redg. Post and obtain POD from PO and certified copy of run sheet of postman.

Since you have resigned therefore after resignation you are not to work thus you have not absconded/absented/abstained.

You may place on record that company’s allegation of ‘Absconder’ is false and it should at once withdraw its letter in writing.

You may approach labor consultant/service lawyer AS AP and show job advertisement, job application, interview call letter, selection letter, offer letter, appointment letter, standing orders applicable to the establishment and extended to your designation (certified/model), any service agreement/bond/Non Disclosure-Non Solicitation-confidentiality agreement signed by you, and proceed under the expert advice of your lawyer.

 

You may issue notice/legal notice to supply by redg. Post the acknowledgment of notice of resignation/resignation, correct FNF statement for verification by you, payment of FNF dues by bank DD only, Form 16, PF number-account slips for each year of employment, salary slip of last month and each month of employment, ESIC Card (if eligible), NOC/NDC, Notice of Determination of Gratuity ( if eligible ), service certificate, relieving letter………………etc

Hai,

I am working in pvt concern. i resigned my job and completed my notice period. From HR department i recieved exit formalities mail. But my immediate supervisor is not releaving me from my responsiblities.How can i get releaving from prsent company

Write preferably thru redg. Post to good offices of Appointing Authority, MD with a copy to Head-HR.

 

In case you are not able to handle the matter on your own let your lawyer handle it.
