Need your consideration

Respected Dignitaries After 14 yrs of toil we won the eviction case against our tenant in the High Court of Gujarat in Oct 2014. While getting the order executed through lower court the tenant than choose to avoid the services of notice. In the mean time the tenant filed the SLP and also got a stay on execution of order to vacate the premises. We are now the respondents to this SLP. The record of proceeding order passed in April 2015 says " issue fresh notice " Till date no notice has been issued. My query : 1. Is there a min or max time within which the Supreme Court issues notice. 2. Can we proceed to respond to SLP before issue of notice on ground of senior citizen. 3. How can we get the interim stay vacated. Thank you in advance. .

2. When the case is come to your knowledge you need not wait for the notice. You can proceed with the case. Whether any caveat was filed by you after the high court order.
